Terms of Use
1. About Us
These Terms of Use (“Terms”) govern your access to and use of all products, services, mobile applications (iOS and Android), web applications, SaaS platforms, websites, and related offerings (collectively, “Services“) provided by KRAFTPIXEL DIGITAL SOLUTIONS PRIVATE LIMITED and its consumer-facing brand KraftPixel Labs (collectively “KraftPixel”, “we”, “our”, or “us”), a company incorporated under the laws of India.
All applications and products published under the KraftPixel Labs brand — including but not limited to Card Action and any future applications — are governed by these Terms.
These Terms constitute a legally binding agreement between you (“User”, “you”, “your”) and KraftPixel. By accessing or using any of our Services, you confirm that you are at least 13 years of age (or 16 in the EEA), that you have read and understood these Terms, and that you agree to be bound by them.
2. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted with a revised “Last updated” date. For material changes, we will provide notice through our Services or by other reasonable means. Your continued use of our Services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our Services.
3. Account Registration and Eligibility
- Some Services may require you to create an account. You agree to provide accurate, complete, and current information and to keep it updated.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You must notify us immediately at info@kraftpixel.com if you suspect any unauthorised access to your account.
- You must be at least 13 years of age (or 16 in the EEA) to use our Services. By using our Services, you represent that you meet this requirement. If you are using our Services on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.
- We reserve the right to refuse registration, suspend, or terminate accounts at our sole discretion.
4. Licences and Permitted Use
4.1 Licence Grant
Subject to your compliance with these Terms, KraftPixel grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install, and use our apps and Services solely for your personal, non-commercial use, or for your internal business purposes where a commercial licence has been purchased.
4.2 Restrictions
You agree that you will not:
- Copy, modify, distribute, sell, sublicense, or create derivative works of our Services or any part thereof.
- Reverse engineer, decompile, disassemble, or attempt to derive source code from our apps or Services.
- Use our Services to develop a competing product or service.
- Circumvent, disable, or interfere with security features, access controls, or usage limits.
- Use our Services in any way that violates applicable local, national, or international laws or regulations.
- Transmit any unsolicited communications, spam, malware, or harmful code through our Services.
- Access our Services through automated means (bots, scrapers, crawlers) without our prior written consent.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Use our Services to harass, abuse, threaten, or harm any person.
- Attempt to gain unauthorised access to any part of our Services, servers, or databases.
5. Subscriptions and In-App Purchases
5.1 Subscription Plans
Some of our Services are offered on a subscription basis (monthly, annual, or other periods) or as one-time purchases. Subscription features and pricing are as described within the app at the time of purchase. We reserve the right to change pricing with reasonable notice.
5.2 Billing and Renewal
- Subscriptions are billed through the applicable app store platform (Apple App Store or Google Play) or other payment processor at the start of each billing period.
- Auto-renewable subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal.
- Payment will be charged to your Apple ID, Google account, or payment method on file upon confirmation of purchase.
- You can manage and cancel your subscription at any time through your device account settings (iOS: Settings → Apple ID → Subscriptions; Android: Google Play → Subscriptions).
- Cancellation takes effect at the end of the current paid period. You will continue to have access to premium features until the end of that period.
5.3 Free Trials
- Where offered, free trials are available to new subscribers only. One free trial per person or household.
- If you do not cancel before the free trial ends, you will be automatically charged for the subscription.
- We reserve the right to modify or discontinue free trial offers at any time.
5.4 Refunds
All purchases are final and non-refundable except as required by applicable law or as provided by the app store platform’s refund policy. For refund requests on the Apple App Store, please contact Apple Support. For Google Play, please contact Google Play Support. For direct purchases, contact us at info@kraftpixel.com.
5.5 Price Changes
We reserve the right to adjust subscription pricing at any time. We will provide reasonable advance notice of any price changes. Your continued use of a subscription after a price change constitutes acceptance of the new price.
6. Intellectual Property
6.1 Our Property
All intellectual property rights in our Services — including but not limited to software, code, design, graphics, user interface, logos, trademarks, trade names, content, and documentation — are owned by or licensed to KRAFTPIXEL DIGITAL SOLUTIONS PRIVATE LIMITED. “KraftPixel” and “KraftPixel Labs” are trademarks of KRAFTPIXEL DIGITAL SOLUTIONS PRIVATE LIMITED. Nothing in these Terms grants you any right, title, or interest in our intellectual property other than the limited licence expressly set out in Section 4.
6.2 Your Content
You retain ownership of any content you create, upload, or submit through our Services (“User Content”). By submitting User Content, you grant KraftPixel a worldwide, royalty-free, non-exclusive licence to use, store, and process your User Content solely to the extent necessary to provide the Services to you.
You represent and warrant that you own or have the necessary rights to your User Content and that it does not infringe the rights of any third party.
6.3 Feedback
If you submit feedback, suggestions, or ideas about our Services, you grant KraftPixel an unrestricted, perpetual, royalty-free licence to use such feedback for any purpose, without any obligation to you.
7. Privacy
Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the data practices described in our Privacy Policy.
8. Third-Party Services and Links
Our Services may integrate with or link to third-party services, applications, or websites (e.g., WhatsApp, Apple Contacts, Google services). We are not responsible for the content, privacy practices, or availability of those third-party services. Your use of third-party services is governed by their respective terms and policies.
In particular, our apps may use the following third-party services: Apple App Store, Google Play, RevenueCat (subscription management), and analytics/crash reporting tools. We are not affiliated with, endorsed by, or responsible for the actions of these services.
9. Disclaimers and Limitation of Liability
9.1 “As Is” Disclaimer
OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9.2 Accuracy of Information
Features such as OCR (optical character recognition) and AI-based text extraction are provided for convenience and may not always be accurate. You are solely responsible for verifying any information extracted or generated by our Services before acting on it. KraftPixel makes no warranties regarding the accuracy, completeness, or fitness of any extracted data.
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KRAFTPIXEL (INCLUDING KRAFTPIXEL DIGITAL SOLUTIONS PRIVATE LIMITED AND KRAFTPIXEL LABS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE OUR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF BUSINESS, OR LOSS OF GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) INR 1,000 (ONE THOUSAND INDIAN RUPEES).
9.4 Indemnification
You agree to indemnify, defend, and hold harmless KraftPixel and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of our Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.
10. Service Availability and Modifications
We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of Services. We do not guarantee that our Services will be available at all times or that they will be free of errors or interruptions.
Features included in subscription plans are subject to change. We will endeavour to provide reasonable notice of material changes to paid features. In the event we permanently discontinue a feature that is central to a paid plan, we will offer affected subscribers a pro-rata refund or equivalent remedy at our discretion.
11. Termination
These Terms remain in effect until terminated. You may terminate your account at any time by deleting the app or contacting us at info@kraftpixel.com.
We may suspend or terminate your access to our Services at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or illegal activity, or for any other reason at our sole discretion. Upon termination, your licence to use our Services ceases immediately.
Sections 6 (Intellectual Property), 9 (Disclaimers and Limitation of Liability), 12 (Governing Law), and 13 (Dispute Resolution) survive any termination of these Terms.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree that any disputes arising out of or in connection with these Terms or our Services shall be subject to the exclusive jurisdiction of the competent courts located in India.
If you are using our Services outside India, you do so at your own initiative and are responsible for compliance with local laws to the extent applicable.
13. Dispute Resolution
Before filing any formal legal claim, you agree to first attempt to resolve the dispute informally by contacting us at info@kraftpixel.com with a written description of your claim. We will attempt to resolve the dispute within 30 days of receiving your notice. If the dispute is not resolved within that period, either party may proceed with formal legal proceedings.
For users in jurisdictions that require arbitration or alternative dispute resolution, we are open to resolving disputes through an agreed-upon arbitration process under the Arbitration and Conciliation Act, 1996 (India).
14. Export and Sanctions Compliance
You agree to comply with all applicable export control laws and sanctions regulations. You represent that you are not located in, or a national of, any country subject to applicable trade sanctions or embargoes, and that you are not listed on any government list of prohibited or restricted parties.
15. Entire Agreement and Severability
These Terms, together with our Privacy Policy and any additional terms applicable to specific Services, constitute the entire agreement between you and KraftPixel regarding your use of our Services and supersede all prior agreements, representations, and understandings.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
16. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of KraftPixel.
